Southern Stoner®, operated by mineNhers, LLC, provides this store, website and related products and services (the “Services”). Shopify hosts and supports the Services.

This Privacy Policy explains how we collect, use and disclose personal information when you visit or use the Services, place an order, create or use a customer account, sign up for marketing or otherwise communicate with us. If this Privacy Policy conflicts with our Terms of Service regarding the collection, use or disclosure of personal information, this Privacy Policy controls.

Personal information we collect or process

“Personal information” means information that identifies you or can reasonably be linked to you. It does not include information that has been anonymized or de-identified so that it cannot reasonably be linked to you.

Depending on how you use the Services, we may collect or process:

  • Contact information, including your name, email address, telephone number, billing address and shipping address.
  • Order and transaction information, including products viewed or placed in a cart, purchases, payment confirmation, shipping details, return claims, approved remedies and past transactions.
  • Payment information processed by Shopify and payment providers, including payment method and transaction details. Southern Stoner® does not directly receive complete payment-card or bank-account credentials.
  • Customer-account information, including your email address, account preferences, order history and information associated with Shopify-hosted customer accounts or Shop authentication.
  • Marketing preferences, including email or SMS consent choices you provide through the storefront or checkout.
  • Communications, including information submitted in customer-support or privacy requests.
  • Device and network information, including browser type, device information, IP address and similar identifiers.
  • Usage information, including how you interact with the storefront, products, pages, advertisements and other Services.

Sources of personal information

We may collect personal information:

  • directly from you when you place an order, create or use an account, join a marketing list, submit a form or contact us;
  • automatically through Shopify, cookies, pixels and similar technologies when you use the Services;
  • from Shopify and service providers that support payments, customer accounts, analytics, advertising, marketing, fulfillment, shipping, customer support and store operations; and
  • from advertising or marketing platforms when you interact with Southern Stoner® through those platforms.

How we use personal information

We may use personal information to:

  • operate and improve the Services;
  • process payments, fulfill orders and provide shipping information;
  • review return claims and provide approved remedies under our Refund Policy;
  • create and manage Shopify-hosted customer accounts;
  • provide customer support and respond to privacy requests;
  • send transactional communications about accounts and orders;
  • send email marketing when you have subscribed;
  • send SMS marketing when you have provided the required consent and the service is in use;
  • measure storefront use and advertising performance;
  • personalize storefront or advertising experiences where permitted;
  • detect fraud, misuse or security threats;
  • comply with applicable law and valid legal process; and
  • enforce our terms and policies.

Cookies, analytics and advertising technologies

Shopify and connected services use cookies, pixels and similar technologies to operate the storefront, remember preferences, support checkout and customer accounts, measure use, prevent fraud, analyze performance and support advertising.

Current connected analytics, marketing and advertising services include Shopify Analytics, Shopify Network Intelligence, Google Analytics 4, Google & YouTube, Facebook & Instagram, TikTok, Pinterest, Klaviyo, BixGrow Affiliate and Judge.me. These services may receive device information, identifiers, storefront activity, transaction information and marketing preferences as permitted by their configuration and applicable law.

Some technologies are required for the Services to function. Other analytics or advertising technologies run according to Shopify’s customer-privacy settings and, where required, your consent. Shopify currently classifies certain Meta, Google Analytics, Pinterest and TikTok activity as data sale, sharing or targeted advertising under some privacy laws.

You can review applicable choices through our Your Privacy Choices page. Depending on where you live, you may be able to opt out of data sale, sharing or targeted advertising. Where applicable, Shopify also treats a supported Global Privacy Control signal as an opt-out request for the browser or device sending the signal and may apply it to an associated Shopify account.

Except for Global Privacy Control where applicable, the Services do not respond to other browser “Do Not Track” signals.

Email and SMS marketing

You may subscribe to email marketing through the storefront or checkout. You can unsubscribe from promotional email by using the unsubscribe link in a marketing message. Unsubscribing from marketing does not prevent necessary non-promotional messages about an account, order or request.

The checkout currently provides an optional SMS marketing consent field. SMS marketing will be sent only where the required consent has been provided and the service is in use. Consent to marketing is not required to make a purchase. Instructions provided with a message may be used to withdraw consent.

How we disclose personal information

We may disclose personal information when reasonably necessary:

  • to Shopify, which hosts and supports the Services;
  • to payment providers that process transactions;
  • to service providers supporting analytics, advertising, marketing, customer accounts, customer support, fulfillment, shipping, fraud prevention, security, storage and other store operations;
  • when you request or consent to a disclosure;
  • in connection with a business transaction, such as a sale, reorganization or bankruptcy;
  • to comply with applicable law, subpoenas, court orders or other valid legal process; or
  • to protect the Services, Southern Stoner®, our customers or the rights of others.

Some disclosures for advertising may be considered a “sale” or “sharing” of personal information or targeted advertising under certain state privacy laws even when no money is exchanged for the information. Applicable opt-out choices are available through Your Privacy Choices.

Relationship with Shopify

The Services are hosted by Shopify. Shopify collects and processes personal information about access to and use of the Services to provide and improve Shopify services, checkout, payments, customer accounts, security, analytics, personalization and other enabled features.

Shopify Network Intelligence is currently enabled. This permits Shopify to use customer data with other Shopify data to improve Shopify products, advertising targeting and personalization, subject to Shopify’s terms and applicable privacy controls. Other merchants cannot view Southern Stoner® customer data through this feature.

Information submitted through the Services may be shared with Shopify and service providers located outside your state or country. Shopify may be independently responsible for some processing and for responding to applicable requests concerning that processing.

Third-party websites and services

The Services may link to websites or platforms operated by third parties. Their privacy and security practices are governed by their own policies. Southern Stoner® is not responsible for the privacy, security or content of third-party services that it does not control.

Children’s data

The Services are not intended for children, and we do not knowingly collect personal information from children under the age of majority in their jurisdiction. A parent or guardian who believes a child has provided personal information may contact us to request review or deletion.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we sell or share, as those terms are defined by applicable law, personal information belonging to individuals under 16 years of age.

Security and retention

No security method is perfect or impenetrable. Information transmitted over the internet may not always be secure, and sensitive information should not be sent through an unsecured communication channel.

Retention periods depend on why information was collected, whether it is needed to provide the Services, maintain records, comply with legal obligations, resolve disputes, prevent fraud or enforce agreements and policies.

Your privacy rights and choices

International processing

Shopify and other service providers may transfer, store or process personal information outside the state or country where you live. This data processing is separate from Southern Stoner®’s current shipping destinations.

Where applicable, transfers from the European Economic Area or United Kingdom may rely on recognized safeguards used by Shopify or the relevant service provider, including applicable standard contractual clauses or an adequacy decision. Southern Stoner® does not make an independent transfer guarantee beyond the safeguards used by those providers and required by law.

Changes to this Privacy Policy

We may update this Privacy Policy to reflect changes to the Services, privacy practices or legal requirements. The revised policy will be posted on this website with an updated date, and additional notice will be provided when required by applicable law.
