These Terms of Service (“Terms”) govern your access to and use of the Southern Stoner® website, storefront, products and related services (collectively, the “Services”). Southern Stoner® is operated by mineNhers, LLC. In these Terms, “Southern Stoner®,” “we,” “us” and “our” refer to Southern Stoner®, operated by mineNhers, LLC.
By accessing or using the Services, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the Services.
Eligibility and customer accounts
You must be legally able to enter into a binding agreement and must use the Services in accordance with applicable law.
You may browse the storefront and place an order without creating a customer account. Shopify-hosted customer accounts and Shop authentication may be available. If you create or use an account, you are responsible for maintaining the confidentiality of your sign-in credentials and for activity conducted through your account.
Information you provide through the Services must be accurate, current and complete. You may not transfer, sell or misuse a customer account.
Products
Southern Stoner® products are made to order. Product availability, offered colors, sizes and other options may change.
We make reasonable efforts to describe and display products accurately. Colors and appearance may vary from what you see on a screen because of device settings, display characteristics, lighting and other factors.
We may update product descriptions, prices, options or availability and may discontinue a product when appropriate. These changes do not alter an order that has already been accepted except where necessary to correct an error or as otherwise permitted by law.
Orders and acceptance
Submitting an order is an offer to purchase. An order is accepted when Shopify or Southern Stoner® confirms the order after payment authorization and applicable review. We may decline or cancel an order for a lawful reason, including a payment problem, suspected fraud, an inaccurate listing, an unavailable product or an error affecting the order.
If an order is declined or cancelled after payment authorization, any release or return of funds will be handled through Shopify, the payment provider and the customer’s financial institution as applicable.
Review product choices, sizes, colors, quantities and shipping information before placing an order.
Cancellations
Cancellation requests are governed by our Refund Policy. Because products are made to order, a cancellation request is accepted only if production has not begun. Cancellation is not guaranteed.
Prices, taxes and payment
The price charged is the price shown when the order is placed, subject to correction of an evident error. Applicable shipping charges and taxes are displayed during checkout.
Listed product prices do not include sales tax. Shopify calculates applicable tax based on the order, shipping address and current tax configuration and presents it separately during checkout.
Shopify and connected payment providers process payment credentials and transaction information. Southern Stoner® does not directly receive complete payment-card or bank-account credentials. You represent that you are authorized to use the payment method submitted with an order.
Shipping
Shipping destinations, rates, tracking procedures, address corrections and package-related issues are governed by our Shipping Policy.
Southern Stoner® currently ships only within the contiguous United States, including Washington, D.C. Orders under $100 have one $5.99 flat shipping charge. Orders of $100 or more receive free shipping within the contiguous U.S.
Shipping and delivery estimates are not guarantees. Please follow the tracking information supplied after shipment and contact us as directed in the Shipping Policy if a problem occurs.
Returns, defects and refunds
Returns, claim deadlines, required evidence and available remedies are governed by our Refund Policy.
Return claims are reviewed for verified defective items, damaged items or incorrectly fulfilled orders. Routine exchanges are not offered. Do not return a product without authorization and return instructions.
Intellectual property
The Services and their original content, including Southern Stoner® names, trademarks, text, graphics, product artwork, photographs, video, audio and site design, are protected by applicable trademark, copyright and other intellectual-property laws.
Southern Stoner® and its registered symbol may not be used in a way that suggests sponsorship, approval or affiliation without written permission. Shopify’s names and marks belong to Shopify. Other names, marks and content remain the property of their respective owners.
You may use the Services for personal, non-commercial shopping and informational purposes. Except where permitted by law, you may not reproduce, distribute, modify, republish, sell or commercially exploit protected material from the Services without permission from the applicable rights holder.
Communications and submitted content
If you intentionally send us a question, suggestion, photograph or other content through an available Southern Stoner® communication channel, you confirm that you have the right to provide it and that it does not violate another person’s rights or applicable law.
We may use the submitted material as reasonably necessary to respond to your request, provide customer service, administer an order, investigate an issue or operate the Services. We will not treat an ordinary customer-support message as permission to publish it for advertising or promotional use.
If we want to publish customer-submitted content for another purpose, we will seek appropriate permission unless the intended public use was clear when the content was submitted.
Third-party services and links
The Services may use or link to services operated by Shopify, payment providers, carriers, marketing providers, social platforms and other third parties. Those services may have their own terms and policies.
Southern Stoner® is not responsible for the content, availability, privacy practices or independent conduct of a third-party website or service that it does not control. Review the third party’s applicable terms before using its service.
Shopify’s role
Shopify hosts and supports the storefront, checkout, customer accounts and related commerce services. Purchases from this storefront are transactions with Southern Stoner®, not with Shopify.
Shopify may process information and provide services under its own terms and privacy policies. Nothing in these Terms makes Shopify the seller of Southern Stoner® products.
Privacy
Our collection, use and disclosure of personal information are governed by our Privacy Policy. Shopify and other service providers may process personal information as described in that policy.
Errors and corrections
The Services may occasionally contain an error or omission involving a product description, price, promotion, shipping charge or availability. We may correct the information and, where reasonably necessary, update or cancel an affected order.
If an accepted order is affected, we will use the contact information submitted with the order when notice is appropriate.
Prohibited uses
You may use the Services only for lawful purposes. You may not use the Services to:
- violate applicable law or another person’s rights;
- submit false, fraudulent or misleading information;
- impersonate another person or entity;
- introduce malicious code or interfere with the security or operation of the Services;
- collect personal information about others without authorization;
- send spam or unauthorized solicitations;
- scrape, copy or exploit the Services in violation of applicable law or these Terms; or
- harass, threaten, defame or harm another person.
Suspension and termination
We may restrict, suspend or terminate access to an account or the Services when reasonably necessary to address suspected fraud, misuse, unlawful activity, a security threat, nonpayment or a material violation of these Terms.
Termination does not remove obligations that arose before termination. Provisions that by their nature should survive—including intellectual-property, disclaimer, liability, indemnification, governing-law and payment obligations—will remain in effect.
Disclaimer of warranties
Except as expressly stated by Southern Stoner® or required by law, the Services and products offered through the Services are provided “as is” and “as available,” without representations, warranties or conditions of any kind, express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, title and non-infringement.
We do not guarantee that access to the Services will always be uninterrupted, timely, secure or error-free. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Southern Stoner®, mineNhers, LLC, Shopify and their applicable service providers, contractors, officers, directors, agents and licensors will not be liable for indirect, incidental, punitive, special or consequential damages, including lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from use of the Services or products obtained through the Services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. In jurisdictions that restrict limitations of liability, liability will be limited only to the extent permitted by law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Southern Stoner®, mineNhers, LLC, Shopify and their applicable service providers, contractors, officers, directors, agents and licensors from third-party claims, liabilities, damages and reasonable costs arising from your material breach of these Terms, your violation of applicable law or your infringement of another person’s rights.
We will provide reasonable notice of an indemnifiable claim when practicable. Any defense or settlement rights under this section remain subject to applicable law.
Severability
If any provision of these Terms is held unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed as necessary. The remaining provisions will continue in effect.
Waiver and entire agreement
A failure to enforce a provision of these Terms is not a waiver of that provision.
These Terms and the policies incorporated by reference form the agreement governing use of the Services and supersede prior agreements or communications concerning that use, except for any separate written agreement that expressly applies.
Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms and related rights or obligations in connection with a legitimate sale, transfer, reorganization or other change involving the business, subject to applicable law.
Governing law and venue
These Terms and any separate agreement through which Southern Stoner® provides the Services are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.
Subject to applicable law, the parties consent to personal jurisdiction and venue in the applicable state or federal courts located in Florida.
Changes to these Terms
We may update these Terms to reflect changes to the Services, business practices or applicable requirements. The current version will be posted on this page with an updated date. Additional notice will be provided when required by law.
Changes apply from the effective date stated in the updated Terms. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.
